Actually the press release is nothing new

The press release says that the judge ruled that the patents are valid. Its says that if Insmed produces their product in the exact manner that Genentech's patents claim then Insmed will be infringing.

The fact is that Insmed doesn't prepare their product in the way that the patents claim so their defenses will be heard by the jury.

The judge did not rule that Insmed currently infringes the patents because she didn't rule on Insmed's defenses.

Actually the trca press release says that Insmed literally infringed 3 claims of the 414 patent but Tercica's press releases have been less than truthful before this so why should they start now.
