Since their was a only a LOI, I would assume that Sheneka Rains becoming COO of Supurva now, would be a violation. "Similarly, once parties have entered into an executory agreement subject to Section 7A’s
requirements, they may not effectuate the acquisition by, for example, merging their operations or otherwise transferring significant operational, management or decision-making control over the to-be-acquired assets." I doubt the CEO of the acquired company could take over as COO of the acquiring company during the phase in which the acquisition has yet to be approved or finalized. There would be too much collaboration because what would happen if the deal didn't go through? Anyone else have thoughts on that? I am not certain but it would seem to be a violation.
