Agree, a few do get prosecuted based on massive scale crime.

What is/was illegal about DUTV? Filing the revenues that did not exist to begin with? The share structure has not changed. If it's proven that McHenry sold some of his 1.2 Billion shares then yes you would have a case. But otherwise, what are you going to prove? And what would the outcome be anyways? McHenry in jail...seems he's already familiar with prison according to public records. There are no assets/cash in DUTV.
