I don't think Jim wants to close this deal while we are under $4. I take that as a very good sign. I read a comment from someone who was worried that they might make this deal under $4 to get insiders in on a low price. This news tells me that that will probably not happen. Sounds like Mr. Nelson doesn't want any more dilution than necessary.
