My guess is this is more nuanced (unquestionably subject to litigation and regulatory action) than you suggest. We both know that young children see the world as only black or white. But some things are black or are white. Attorneys and moral relativists (do I repeat myself?) can and will litigate and debate this for years, but IMHO, it's just plain wrong.
