Let me set this straight:

- The PACER documents were posted on this board in which Jeannette Bleecker HERSELF explains that she switched the Control and Bavituximab arms.

- A settlement has been made public with CSM paying damages to PPHM.

- A SUMMARY Judgement has been made public forbidding PPHM to pursue the "INTENTIONAL" leg of their claim because they were TO LATE to add it. This forced settlement within the contractual cap/limits of breach of contract. This is a PROCEDURAL based summary judgement and the judge doesn't say anything about the sabotage itself. He just says, not here, not now, not in this trial, you should have filed that earlier.

- Why would CSM even pay 1$ to PPHM if they didn't mess up, let alone hundred of thousands of dollars and legal fees, because also CSM's lawyers don't work for free.

- Except that by the first point it shows this is a false statement because JB confessed about the switching, the documents (PRs) you refer to that would suggest even the BEGINNING of PPHM's involvement in the dose switching ARE NOT EXISTENT.

- Except PPHM no other party has ever written a PR about the dose switching incident. Non of these PRs say what you claim and no others could be found. Pls provide the link supporting your statements.

The placebo and 1 mg/ kg bave were switched but that meant that the first numbers PPHM reported 5.6 month MOS for the placebo were actually for Bavi! How come the MOS for the 3 mg/kg changed as well going from 13.1 months to 11.7 months in that heavily censored arms.
No sabotage- Bavi doesn't work

- This is another misrepresentation. It has been established that JB managed only to pollute the CTRL & 1mg/Kg Bavi ARMS for 25% and the 3mg arm remained untouched. So patients in the Bavi 1mg arm didn't get all there due Bavituximab and those in the Control arm got 25% Bavi they shouldn't have got. In other words that Bavituximab arm scored BETTER then announced because its current results were obtained under a 25% handicap and the control arm under a 25% advantage. Furthermore the 3mg arm was ALSO compared to a control arm that got 25% Bavi which puts the 3mg arm in the disadvantage too. Results of SUNRISE will therefore be BETTER then the PII.

- Bottom line, Bavituximab works MUCH better then announced by PPHM on Sept 7th, 2012 and VERY MUCH better then the conservative salvaged numbers PPHM filed with the FDA which showed only a 70% improvement rather then 113+%.
