Exactly, just what is the nature and the terms of their relationship, is it merely a seller buyer relationship (unilateral agreement), or is it, an actual joint venture between Cummins and Coates (bilateral agreement).
Example 1) Joe goes to a Ford Dealership and purchases 2015 Mustangs in which he intends to customize and resell to other customers. In this case Ford is merely supplying automobiles to Joe, which is a unilateral business agreement*. In a unilateral business agreement there is only one promise that needs to be kept (Anyone who pays X amount, receives the particular good or service offered from the vendor)Even though the sale is limited to being a cash and carry purchase, Joe is not committing fraud by stating that he has a working relationship with Ford.
*Joe intends to alter the automobile, so Joe has waived the 2015 Mustang's warranty. The warranty would have qualified the transaction as a bilateral contract, in which each party has agreed to future obligations and promises to the other.
Example 2) Westport Innovations is a Joint venture between Westport Innovations & Cummins Inc. In this situation there is an ongoing working relationship between the two corporations. Each entity has made promises to the other to perform, this is a bilateral business agreement, in which there are two promises being exchanged between the two parties. Party A promises to perform certain obligations to party B and party B promises to perform certain obligations to party A.
As I have stated before the OTC companies are notorious for releasing PRESS RELEASES that are vague and ambiguous. It amazes me as to how many posters on this blog have assumed the latter, in which there is in fact an ongoing bilateral agreement between Coates and Cummins Inc. Not one of the press releases have stated this as fact. This is why I think that the truth is being stretched here. If there was in fact, an ongoing bilateral agreement between Coates and Cummins, it would be spelled out as clearly as the English language could articulate it. Just the news in itself, that Coates is receiving shipments from Cummins is positive news though.
