You know this kind of approach to tell publicly to short company remained me a situation where two companies fighting for a patent of one of them.
For example: Apple against Samsung. In case, Samsung has used a patent of Apple with no permission, so Apple could appeal in the court. Finally, Apple won litigation and was awarded, but a bottom line Samsung earned much more than it payed to satisfy Apple and it was worth to steal.
Probably, Corker took the same approach as in case of Apple against Samsung.
