Oh here we go with another Dog and Pony show. Rather than arguing the case on merits, HHSE is trying to pull a technical move to stall the case rather than just argue the merits of it. Its just a stall tactic and if HHSE had a leg to stand on in this case they wouldn't be spending money on their lawyer to write and file this which all costs money. More Shuck and Jive and shareholders money being wasted.
