Sorry Heartofwolf, but your source is likely not credible, for no less reason than making their last part of the rumor that the CA wasn't going well and that it looks to have merit. You see, it is in appeals, the first judge already heard three rounds of testimony and still came out that the plaintiff didn't have anything. The appeals court rarely over turns the first judge unless that judge is corrupt or incompetent or just flat out came out of the blue with his ruling to where it was obvious there was extreme bias. The judge gave three opportunities to the plaintiff....they blew each chance. Not likely to be successful. And how would anybody know how the appeals judges are swaying?...they can't ....not until they rule on it. So, this alone shows that the rumor is based on someone's beliefs or feelings....they don't have any more a clue than the rest of us. I dismiss the rumors as just what they are, a biased persons opinion...nothing more.
