That is incorrect. Someone can't say "it's my opinion that so-and-so is a thief who is going to steal from the company." That CAN be refuted, and it is libel. It is not an opinion that is protected speech. It is an allegation of future wrong-doing, and is actionable in a court of law.

Unfortunately most of the time libeled parties do not go after the libelers, both because doing so causes even more attention to those statements, and because the time and aggravation is usually not worth it to the victim.
