Even after all that has come to light and all of Vringo's victories overseas, it's only in Brazil and Romania that ZTE's business is actually being materially impacted.... And even if Kaplan hits these guys with a $2m sanction, it's just a cost of doing business for them... Without a major judgement (>$50m say), I think ZTE is largely undaunted... Just cost of doing biz... Now an injunction in the U.S. would be a powerful impact on them... But no one seems to expect this... So unless UK or France or Germany or India really slam them, I think they'll take their lumps on SDNY sanctions and continue business as usual... When Vringo finally gets awarded a significant judgment for the NDA breach, they'll appeal... And the game will continue
