If it doesn't matter, why did they use the pump "news" that they get to spend money (shares) to pursue a lawsuit if it's old news?

Do they honestly think IF they win any damages would be awarded? Sales of the product are poor to begin with... if claiming damage to goodwill, what goodwill...? What a joke.
