Again, I don't think they can refuse a license offer on Frand Terms. This was because they are an NPE. The court granted VRNG an injunction because ZTE was not trying to get a license on truly Frand Terms. They wanted a lower cost that was unfairly calculated to their (ZTE's ) benefit. The court saw that ZTE was not negotiating in good faith. At least this is my understanding. Feel free to correct me if I'm mistaken?
