To prove intent, there would have to be a document from their hired advisors that it waould be indeed the CDs and not an overreaction by a bunch of novice investors. And then knowingly, they would proceed despite the advice they got...assuming you could get the document into court, if it exists at all. Good luck. Note, I am not a lawyer.

If you can't prove intent, then they either claim they didnt know better or that shareholders overeacted and they have no control over that.

I would agree with them that it was panic and not the conversions and point to April as proof.
