I disagree. The court entered judgment dismissing 4 of 5 claims brought by PPHM. The only remaining claim is breach of contract where damages ARE capped.

The court said the economic loss claim would not have applied to an "intentional tort." PPHM's lawyers tactically chose not to plead an intentional tort.
