The definition is de jure along the the GSEs legal charters, and regardless of temporary conditions established by conservatorship and third amendment and the resulting de facto nationalization, that legal definition and those charters remain and will be used in court in relation to HERA 2008 and the statutes therein unless the law or charters are changed by Congress.

A "taxpayer-sponsored enterprise" is not a legal or corporate entity. It is a made up name with no legal force or rights. Of course, it can be used to label Fannie and Freddie. However, it can amount to no more than a personal or group sentiment or opinion and not a recognizable and enforceable legal fact.
