Anyone wishing to take Mabwe to court had better hurry to file action. When the Fonon takeover is officially complete, there may not be an opportunity as Mabwe Minerals, Inc. will no longer exist and I'm not sure that any recourse would be available after that time. If claims are made against the company while it still exists, then the new company may "inherit" the claims against it.

Check with a lawyer to determine how claims against the company before and after the takeover of the company shell would handled according to Zimbabwe law. Again, if claims are made against the company before the takeover of the shell is complete, the new company may "inherit" the liabilities. That could possibly stop the takeover, at least until the suits are settled.

There are laws against fraud but the injured party usually must make a complaint. I know for a fact complaints have been made against Mabwe and Raptor. That is more than likely why they "folded the tents" so quickly. Prosecution may be a ways off though as they want to build the maximum case before bringing charges.

It's unlikely that shareholders would ever see anything. Any and all assets could be attached I suppose, but I don't think they actually paid for anything except with empty promises.
