It is not possible to directly know what is in the minds of the government attorneys...

We do know that the government wants Fairholme and others to be dismissed from the case without ending the case itself.

So, if Fairholme is ousted from the case and if the Government loses the case, what would the speculative amount of dollars in compensation be without Fairholme in the case versus with Fairholme in the case?

Not having to pay additional amounts of compensation to the largest shareholder in the case would be sufficient incentive for the Government to make this 5 page motion in addition to gumming up the works, slowing the proceedings down, casting negative lights on shareholders and dampening share trade.
