The trial has been pushed by TMM into 2016 or maybe 2017 as you already know, not in three months. This next hearing is just for the purpose of the Judge confirming a stipulated schedule as the docket says. That presumes the two sides have agreed on a schedule yet but what is not in doubt is whether this trial is indefinitely postponed into next year or beyond.

And with TMM serving HP now the impact of that "hammer" has yet to be incorporated into the schedule.

All of that indefinitely postpones any chance of TMM making any deals.
