He didn't release a PR guidance today saying that the company is pursuing legal action against this guy.

He could have, but he didn't.

They knew about the mistake on the K weeks ago, and still haven't done anything.

Wouldn't you release a strong PR reassuring your shareholders that legal action is being taken?

Stop trying to hang onto a thread of hope. This ticker is done.
