Not if someone is saying factual postive things while they are either buying or holding shares.

What Duke has done is spread hundreds of fear messages on this forum with intent to manipulate. Now he has admitted in print he has been buying it and flipping at times, which was clearly happening while he was downramping it.

This is clearly an SEC violation.
