That was the first thing I thought as well. If anyone knows whether they are defendible or not it should be JNJ at this point. The only other logical reason (to me)for them not buying them first would be the patent
holder refusing to sell them to JNJ for (maybe) personal reasons/dislike of JNJ and their business practices. If that is the case then his asking price for JNJ only could have been exceptionally high. The sale to DECN could include some kind of settlement sharing with no real financial risk at all.A true win/win
