As stated before the SEC did not find this matter serious enough to ban him from participating in a public offering nor becoming the CEO of a reporting company. He subsequently was the CEO of 2 such companies.
Furthermore, that Civil case and matter was settled many years ago.

He has been before, during and after this matter a well known and well respected business person. His associations with Michael Bloomberg, Robert Downey Jr., Olivia Newton-John, Dick Cheney(former chief of Halliburton-not to mention VP of the USA) Dennis Hayes, and T Boone Pickens, etc. are also known.

Furthermore, he is a VP of that JV. There are others, both senior and junior, both management and advisory, that run that company and its ventures.
