Government contracts for the most part do go to the lowest bidder on fixed price contracts. However, under best value contracting, the government can award contracts based on cost, performance and other criteria as stated in the solicitation. These types of contracts can be fixed price but more often are cost type contracts. You are correct in stating that if DDSI has a patent and the government needs that particular service or product, then they will go to DDSI to get it, of course provided that the cost are considered fair and reasonable. Unless it is deemed a national emergency and is in the best interest of the public.
