You can dismiss this issue as you wish; but, it is real. Infringement on UND patents will rely on UND taking enforcement actions with both notifications and, quite probably, legal claims in court. Knowing how reluctant universities are to take such steps, this is not nearly as good of a position for KBLB as would be having the patents assigned. Further, SCOTUS has not looked favorably at EXCLUSIVE LICENSES of patents in most patent infringement cases. They have essentially stated that patents are not intended to be used to prevent commerce or block competition. Instead, they are intended to provide the patent owner with a fair royalty for their innovation's value-contribution in the marketplace. That's two significant points that IMO should cause some concern instead of being dismissed as not relevant.
