I agree with you and I definitely feel like this breaches the contract but I'm not a lawyer and I have no idea about his contract with Marvel. For example, could Marvel create an action figure of Stan based on his character in their movies? Or based on the Stan Lee that worked at Marvel? As the interchangeable heads and wardrobe on this figure suggest. Perhaps their agreement allows for this sort of shenanigans.
