I think that PPHM will now quickly be able to know if JB or Finken worked on MERIX or not. With that, or even without that, they can always file at the Illinois court.

The Californian court didn't say PPHM cannot have the MERIX information it only said that the ways PPHM tried to get the information where either not appropriate or not for the Californian court to grand. The Judge gives a clear hint that the way to these documents is via the Illinois court and not through any other short-cut. I think this is a correct judgement.

And the judgement about forcing CSM to produce JB employee information is also a correct one. It would be a little to easy to be able to hide potential incriminating information behind privacy rights.

Given the choice between both I would have gone for the JB's employee files because the MERIX files remain a gamble, they could bring northing to the surface as they could shed light on many things going on in Fargo.

The employee files on the other hand should show us if JB took a leave of absence or was forced to take one, if there is a reason, if they kept paying her, if she got some kind of bonus for her good work on PPHM clinical trial :), how she left in august and why she never came back, etc, etc, etc. Furthermore if she transferred the clinical trial to Finken or someone else there should be a document there. Possibly we'll also find traces of how JB's secret records where discovered. And we'll get extra information on Angela Buchanan, JBs manager, because the Judge clearly included ALL information and communications.

So something to watch is at WHAT LEVEL and EXTEND did JB in FEB go on leave including Angela and HR in her communication or did she interact directly and possibly only with Finken.

In a NORMAL company situation you go to you Manager and ask for the leaf, and the manager may need to escalate it higher up or take it up with HR, or you go to HR that involves your manager then. What you normally do NOT do is ignore them all and step to your CEO that then takes over your clinical trial.

So yes, those JB employee files are a peace of key information.
