they won't be able to produce the Tyche shares for the BIGN naked shorts they sold. All Tyche shares will be restricted so there will be nothing free trading they could pick up. Someone that thinks they own real BIGN shares will actually only own the naked shorts and therefore won't get their Tyche divi. The SEC would get involved with this type of fraud if it happened. Now, if someone is naked shorting, they could be betting that BIGN/Tyche will never pull off issuing the shares. I don't think I would be taking that bet.
