Don't you believe that the company has sued J&J enough? If the company sued J&J on behalf of shareholders it would be just another lawsuit for the pile, and it would be heard in the same court.

A third party derivative suit (reverse derivative) prosecuted by people with money and clout and in a different venue where the damage occurred should be exquisite.
