Finally received confirmation from Howard Master at the DOJ-

Mr. XXXXXXXX:

Thanks for your email. I believe we have received a copy of your petition; there is no need to visit us in person to deliver it. Feel free to email us a copy as well. We will pass the petition on to individuals in the Department of Justice who review such petitions, but I want to make sure you and Mr. LeFrancois know that the possibility of collecting any substantial payment from the Levys as a result of the petition is limited by: (a) our efforts to collect funds from the Levys, which have been challenged by the Levys' efforts to secrete assets abroad and the fact that many of their assets here were mortgaged/subject to liens, (b) the large number of victims, including individuals who lost money as a result of their purchase of GDGI and other stocks targeted by the Levys' fraud, and (c) legal limits on the types of losses that are compensable under federal criminal law. Consequential damages, for example, are not compensable -- only direct losses, less amounts paid to the victim, are compensable. Please see the brochure found at the attached link for more information: http://www.justice.gov/criminal/afmls/pubs/pdf/victms-faqs.pdf

We wish we had better news concerning the prospects of financial recovery via the criminal process, but we want to make clear that we do not mean to foreclose other relief that Mr. LeFrancois may wish to seek via private actions, tax filings, etc.

Sincerely,
Howard Master
Assistant U.S. Attorney
Southern District of New York
