Yes, they are touching the Cannabis Sativa plant as hemp is the cannabis sativa plant. They are using the parts of the cannabis sativa plant that are excempt from the definition of marijuana under the US Controlled Substance Act. Only the leaves and flowers of the cannabis plant are defined as marijuana under the controlled substance act and those parts are the schedule 1 drug.
