That's why i'm talking about actual commercial products that were released on the marketplace before the Patent was filed.

Products that already "embody" the patent claims, before the filing date.

As a defence, it suffice for the defending party to show any such prior commercial product, and the patent is declared null and void, due to prior art.

That's why overbroad patent claims are in fact very weak.
