Class Action Lawsuit guys... I've mentioned this before. Read the Time Magazine article from May 2009. Bianchi outright lied saying Drank would be in major and specific stores by the end of the year. I don't have the article, but I believe he mentioned CVS, Walgreens, and Safeway by name.

Supreme Court recently locked down on class actions by stockholders, you can't even file without evidence the dishonest practices led to an increase in stock prices.

WELL... Look at the charts. The article ran on 5/9/09. It had closed the previous day at $1.40, then skyrocketed To $2.50 within a single month! The prices jumped 10 cents the very next day after the story ran. I think we can argue his LIES caused this impact on stock prices.

Beyond that, time after time they have reported false statements about their intentions... Where is the proof they ever attempted anything they mentioned in their BS year end report a couple of years ago...

I don't have the time or means to investigate much further but I hope one of you two-three folks who have watched our investment rot and die together is friends with someone who could at least answer if it's a legitimate suit to consider. I'm one of the suckers who kept buying as it surged, so even if they paid out on the amount anyone was robbed by paying over 1.40 at the time I know it would be worth a whole lot more than my shares are worth now.
