If IFX sells or is acquired, the settlement deal on royalty rates, patents and rights only applies to a portion of the production of the combined successor organization; the portion represents the production volume of IFX at the time the merger commences. IFX is a small producer of DRAM; MU would still have to get a license for the remainder of production, IF MU wants to produce infringing DRAM in quantities greater than IFX had at the merger pt.
