I just hope that behind all the strategizing and related posturing, Mr. Berman balances the importance of the actual business opportunities with the focus on maximizing the "return" on the litigation efforts. In other words, enter into a favorable settlement (rather than dragging it out trying to squeeze every red cent) and get onto revenue growth, retail channels, etc. which will propel the stock much more than protracted settlement talks while competitors penetrate the market. He appears a smart enough guy to strike while the irons are hot.
