lets be clear my wager upon trial the joint venture meeting in hk oct 08 is brought up again..the documents were drawn up in behalf of sw and malcolm and mr garrison should have copies they failed to sign.i do not doubt that sw tried to rob eegc and shareholders but their bully tactics failed miserably.true no jv documents were signed and judge oing decreed there was no jv agreement with eegc..but in atty batista own words below [i have his permission to do as i wish] he clearly gives a synopsis with meaning of where we stand going forward.while i was not going to share excerpts of atty batista reply i decided followers and shareholders might be confused here and so they deserve to read his thoughts .atty batista is a tremendous atty really pretty much a household name up there with the other big time names of great attys..i wish to express my thanks and gratitude to atty batista for doing a tremendous service for eegc and shareholders.imo

Although the judge did rule out of the case the claim that Empire had a joint venture with Smart Win, he left fully intact Empire's central claim that Smart Win breached its contract with Empire and ruled that Empire is entitled to prove ALL the damages that flowed from that breach by Smart Win. If damages are awarded in Empire's favor on the breach of contract claim, those damages could be the same as if the alleged joint venture had remained a part of the case.
