Sinclair International v. FMC Corporation
We represented Sinclair International, Ltd., the world’s leading manufacturer of systems for applying plastic labels to fruits and vegetables, in several lawsuits against FMC Corp., a leading supplier of agricultural equipment. The most recent suit charged infringement of a Sinclair patent covering inventions for labeling produce in citrus packinghouses. We prevailed on a motion for a preliminary injunction prohibiting FMC from using Sinclair’s patented label strips, and the case was later resolved after the entry of a stipulated permanent injunction against FMC’s use of the label strips. This injunction followed on the heels of earlier litigation in which the firm also obtained preliminary and permanent injunctions prohibiting FMC from making related machines. The earlier suit charged infringement of three Sinclair patents covering inventions for labeling produce in citrus packinghouses. In that case, we also prevailed on a motion for a preliminary injunction prohibiting FMC from entering the produce labeling market using Sinclair’s patented technology and the case was later temporarily resolved by entry of a stipulated permanent injunction prohibiting FMC from making the machines at issue. FMC then filed suit for a declaratory judgment that its new machines do not infringe Sinclair’s patents, which was dismissed.
