Affinor Growers removed from Abattis suit by court

COURT ORDERS ABATTIS BIOCEUTICALS TO CEASE EMERGENCY MOTIONS AGAINST AFFINOR GROWERS INC., AFFINOR GROWERS LLC AND NICK BRUSATORE. JUDGE AGREES THERE IS NO BASIS FOR SUCH CLAIMS BY ABATTIS

In a temporary restraining order hearing in Washington, the court ordered that Affinor Growers Inc., Affinor Growers LLC and Nick Brusatore should not be included in these proceedings. Mr. Brusatore's lawyer, Kevin Sullivan, explained that there was no basis for such claims and the judge agreed.

The court made a very limited order, which was much less that what had been requested from Abattis. Herbal Analytics's attorney, Ray Brooks, informed the court that Herbal Analytics was not using any documents obtained from Phytalab and did not intend to use them.

Based upon that alone, the court ordered Herbal Analytics to continue to do the same and to preserve documents. Another hearing was ordered on the matter for Nov. 24, 2014. This was way less than Abattis had requested. It had proposed an order finding that Herbal Analytics' employees had breached fiduciary duties and that they had caused damage to Phytalab. The court did not find this, nor did the court find that anyone at Herbal Analytics had committed any sort of theft of its intellectual property.

In short, the court ordered that Herbal Analytics continue to do what it has agreed to do all along, that is not to use any information that Phytalabs former employees may have had access to while they worked there. Herbal Analytics was not restrained from going forward with its own plans to operate as a certified tester of cannabis and marijuana products, including drug discovery and other herbal research. The narrow court order specifically states that it does not apply to Affinor Growers Inc., Affinor Growers LLC and Mr. Brusatore.

Affinor Growers Inc., Affinor Growers LLC., Mr. Brusatore and Herbal Analytics fully and completely deny all wrongdoing and plan to vigorously defend the meritless lawsuit filed by Abattis.
