No worries. In my thinking I was assuming that it would be the whole agency since both Director's overseeing the agency have given the Treasury 100% of the profit that could have gone to recapitalization. I would think then that it is based more on agency "principles" rather then the Director's order.

If FHFA is found to be an arm of the gov't then that would mean the gov't would be found to be an unlawful conservator, so would a court system still allow the gov't to choose a conservator even though it was already found to be an unlawful conservator?
