Herein lies the problem on a much grander scale.

The government is not necessarily contesting that FHFA is doing wrong. They even admit that FhFa could be making a bad decision with the sweep. They don't care. The government's argument is FHFA can do whatever it wants because it is protected by HERA insofar as not being able to be prosecuted for any reason whatsoever.



Having the ability to do what you want does not free you from the consequences (positive or negative) of your actions, no matter what you interpret on paper. That is Universal Law and applies 24/7/365 (also includes leap years, too).
