11/04/2014 ORDER granting 388 Motion for Leave to File as to Michael Metter (1), Andrew Tepfer (3), Seymour Eisenberg (4), George Speranza (5), Thomas Cavanagh (6), Frank Nicolois (7) --- The Court reluctantly grants the request of the three lead plaintiffs ("Plaintiffs") in the Spongetech shareholder class action, In re Spongetech Delivery Systems, Inc. Securities Litig. Docket No. 10-cv-4104, leave to file affidavits of loss, even though they were submitted past the September 30, 2014 deadline set by the Court by Order dated August 26, 2014. While the Court finds it difficult to believe that counsel for Plaintiffs was unaware of the deadline given his access to Pacer and the government's efforts to solicit affidavits of loss from the victims here, the government does not oppose the application and asserts that the inclusion of these affidavits of loss will not pose an undue burden in calculating the overall loss here. The government is directed to serve a copy of this Electronic Order on counsel for Plaintiffs within two days of the date of this Order and immediately thereafter file proof of such service with the Court.
