Reading the case about the child. It appears that the 2 year old was alone on the road at midnight. And was hit just after the driver was blinded by construction zone high intensity lights in his eyes. The driver never saw the child and thought perhaps it was a dog that ran in front of the car.

I guess that is why the State Police never charged the driver with an accident involving a pedestrian.
