Once again - while not perfect Harmoney - I agree
One can not just change a contract post fact
And if HERA did give such high level non traditional power to FHFA it did so ONLY under a receivership
We are not in receivership (which allows walking away from promises like debt)
I fail to see how the CONSERVATOR change a contract post fact
Indeed I do not think the Conservator acted independently which is worse and one angle of Fairholme if I understand their stuff
So NOPE - other than in battle mode which they were not in can they change unilateraly after the fact
again - they could IMO have switched out of Conservator to Receiver - appointed a Receiver and then ....
They did not and thus using receivership powers is WRONG IMO
