I was there along with Infringeon2003, yusdbk, Mike Cohen, and a few others. The courtroom was not crowded (unsual).

Judge Whyte was also deciding on whether or not to allow the entry of a few exhibits into evidence. Rambus did OK, especially on a 1992 email by a Hynix employee who Rambus had subpoenaed.

Since the Hynix employee is a Korean, Rambus could not force him to come to the trial, of course he refused to come.

Hynix argued that Rambus could not lay a foundation for the email since the Hynix employee (Kil?) was not there to testify to the email, therefore Hynix contended that the email could not be used by Rambus.

Judge Whyte allowed it in because Judge Whyte said that enough foundation was established in a deposition where Kil testified that he was a Hynix employee who was in charge of evaluating new technology in 1992.

The email was sent by Kil to his superiors and it was outlining new technology by Rambus, DLL and ?(I didn't hear).

It is going very good for Rambus in this patent trial.

The conduct trial was postponed from May 15. A date has not been set.

Yesterday, Rambus proposed June 19, Hynix attorneys said that date was no good. Hynix proposed July 24, but Rambus wanted either June or July 17 at the latest. Hynix said Hynix attorney, Nissley would not be finished with ITC trial until July 14 and that would not give him enough time to prepare for the conduct trial.

Judge Whyte said he is going to be out a week, either the week of August 1 or the week of August 8, he was going to check his home calendar and let the attorneys know which week.

Rambus said the conduct trial might take 2 weeks depending on what issues are taken out with summary judgements, while Hynix attorney Brown said it would take at least as long as the patent trial. Hynix said Nissley would also be at another trial sometime in August, I don't remember when.

Judge Whyte said for the two sides to talk together and submit dates to him and then he would decide.

I have attended every day of the patent trial and it is my opinion that if the jury is not fixed, Rambus will win the invalidity and infringement.
