The Perry Capital case in the US District Court for the District of Columbia before Judge Lamberth seeks to vacate and set aside the third amendment to the PSPAs that includes the net worth sweep.
Judge Lamberth is not considering a federal takings case. Federal takings cases related to violations of the takings clause of the 5th Amendment to the US Constitution are heard in US Court of Federal Claims.
All of the required motions and cross motions in the case have been filed.
A hearing is next. It is assumed that at the hearing oral arguments may be made in support of motions and cross motions in order to resolve issues of fact, evidence and law, case dismissal, summary judgment or continuation onto trial.
