"It has always seemed to me that a patent on a discovery of some thing that always existed in the natural world could not be as strong as one on the invention of something completely novel. "

i agree...and i doubt the patents that are held that fall into this category will hold up...as for the rest of the patents, i agree with jazz that they are now or soon will be easily worked around...it seems to me that gene splicing itself is not patentable... just the method used... if you do it differently, it is not a "copy".. its is in fact different...

"ie. said competitor would need to fight to overturn the UW patents, "

said competitor does not have to do anything...they would only have to defend their process if they were sued by the patent holder...and a costly suit would only be attempted if they thought they had a good chance of prevailing...and had enough reason to want to...

how much does UW stand to lose by not suing vs how much do they stand to gain by doing so?...is it worth the time and cost to them...it certainly might be to kblb... but they dont have the wherewithall to do it...so the question is, is it worth it to UW?...

"The number of brick walls in their road makes it much less likely that anyone will really try. "

i think those brick walls are about 2 feet high...and crumbling as we speak...
