Let the patent office decide if the patent is valid
Let the courts decide if an entity is violating a patent.
Courts determining if a patent is valid after the USPTO has already done so undermines the system.
Before I could spend a few hundred dollars and get the patent. Spend a few thousand and hopefully enforce it. Now, you could spend millions and lose it all based on an uneducated opinion (in the areas of technology) of a single judge.
This is a real mess.
I think Judge Chen understands where we are headed.
