1)One of the active judges will call for a vote. Any one judge can call for a vote? Or the Court has protocol that a pre-determined judge is assigned this duty?
2) Will the 3 judges who involved in this "obviousness" decision be recused from voting in the granting AND the actual review processes?
3) Do you have any idea or rough guess how many judges will participate in the granting and the actual review processes?
(If the 3 judges who involved in this "obviousness" decision are all participants in the voting processes, then obviously Vringo will have 2-1 disadvantage to begin with. I'm just trying to figure how many more "yes" vote Vringo will need to overcome the 2-1 disadvantage).
