I agree with ownerofbusiness – I was there.

Judge Kramer mentioned the First Amendment. The Honorable Judge will not deprive us of our First Amendment rights. In my view, Judge Kramer is not going to deny Rambus (and their shareholders) their right to these non- privileged documents. I believe that there are 12 distinct documents. According to Rambus’s attorney Joe Cotchett, Rambus’s shareholders are “vitally important” to the issue. He went on to explain why it’s very important for Rambus’s shareholders to know why Rambus is pursuing this litigation and fighting so hard in court.

Everyone, I’ll make this short since I’ve had a very long day -- I can just tell these documents are DYNAMITE. To date, I have not seen a stronger plea than I saw from the Micron attorney to keep these documents under wraps. She appeared flat out desperate to keep the documents from getting out into the public domain. She even whined about the fact that Rambus is going to run to the Wall Street Journal with the documents.

Judge Kramer was not impressed. In my view, the only reason Judge Kramer let her go on and on was to cover all of his bases for the appeal. On a side note, Judge Kramer was very well prepared and the Micron attorney couldn't get the edge she was fighting for since Judge Kramer had already read all of the case law cited in thier breiefs.

Bottom line, it appears as if the appeal route will be exhausted within 35 days or so and that Rambus will have access to the documents. However, there was a stipulation made so that Rambus’s Board of Directors will have access to the documents right away – however, the directors are BOUND by the protective order.

I am not going to get into the nuanced details at this point because they are complex. I am tired and infringement commences early tomorrow AM. But Judge Kramer will issue a one line order releasing the docs in the near future. However, more briefs will be filed and the appeal must run its course – as I said about 35 days.
